Israel’s Judicial Conundrum

Reality check: the unpopular and perhaps controversial thought that must be said is that Israel is not only engaged in a battle with terrorists. Israel is also entrenched in a judicial conundrum that also puts its democratic governance foundation in jeopardy.

The First Problem

No one in the Western world can truly understand, perhaps do not want to put themselves in that situation, what is it like to live next door to monsters who sanctify death and are raised to be terrorists; two-legged beasts who live for one purpose, which is to hate you and wish you dead.

Obviously, I point at Hamas in Gaza. It may not be obvious to Westerners, but the people of the Palestinian Authority (PA), who after Israel’s victory in the 1967 Six Day War and according to the 1993-1995 Oslo Accords were allowed to remain living in parts of Judea and Samaria, are not much better than Hamas.

Who is Hamas?

Hamas, abbreviated, the Islamic Resistance Movement. It is a collection of nationalist Sunni Islamist militant and political Arab organizations, its military wing is the Al-Qassam Brigades.

Hamas was elected by the Gazans to rule over them in 2007 after Israel unilaterally exited, hoping to gain peace.

Each day these barbarians repeat the mantra, we want to destroy Israel and murder every Jew living there.

The 3-Phase Ceasefire Deal

The 3-Phase ceasefire deal is a hostages – and Arab terrorist prisoner exchange aiming by the 3rd phase to achieve the end of the war.

The agreement is between the state of Israel and the terror group Hamas, mediated by the United States, Egypt and Qatar, signed on January 15, 2025. It came into effect on January 19, 2025.

The agreement, stretching over a series of initiatives in three phases, began with a six-week ceasefire.

First Phase

In this phase, Hamas would release 33 living Israeli hostages. If the total number of living children, women, elderly, female soldiers, and sick or injured men is less than 33, then Hamas would make up the difference by releasing deceased bodies of Israelis they use as a bargaining chip as well.

In return, Israel would release up to 1,904 terrorist-prisoners, including 737 serving life terms. Those life-termers are murderers of Jews.

Israel agreed to allow the entry of “sufficient” quantities of humanitarian aid into Gaza. That aid included fuel trucks delivering sufficient fuel necessary for power plant operation, hospitals and other miscellaneous services.

Additionally, Gazans who moved away from the northern Gaza war zone shall be able to return to their homes, and Israel would gradually withdraw from some (but not all) parts of the Gaza Strip while limiting its military flights over Gaza.

Second Phase

In this phase, Hamas is due to release all the remaining alive Israeli hostages. In return, Israel would release an agreed number of terrorist prisoners and the withdrawal of remaining Israeli soldiers from the Gaza Strip.

Third Phase

In this phase, Hamas is due to release the remains of all deceased Israeli hostages and captives, in exchange for Israel releasing the remains of deceased Gazan bodies that it holds.

Israel would end the blockade on the Gaza Strip and Hamas would be disarmed and would not rebuild its military capabilities.

Ridiculous Deal

We all are dismayed by this, very possibly disastrous, deal we can call an uneven exchange structure. We all know that it makes no sense to release over 1,000 terrorists, many of whom have murdered Jews, in exchange for 33 Israeli civilian hostages in the first phase. These hostages were abducted from their homes during the October 7, 2023 Hamas massacre spree of over Israeli 1,200 civilians in southern Israel.

However, once this pathetic deal was signed with the devil, there is no other way but to shift the focus to bringing back as many hostages as possible before it’s too late. Focusing on taking them out of Hamas’s murderous claws.

Dealing with Hamas, a vicious to a fault terrorist organization that abides by no law, is complicated and dicey.

What Is Israel’s Real Problem?

Israel’s other problem is not only how to conduct itself with Hamas and the deal it agreed to.

Israel’s current and must-be-dealt-with other problem is the cancer within its society, within Israel’s walls, which is the vocal anarchist political progressive-left that is weakening every aspect of Israeli society.

They are funded by many foreign entities and act primarily through the majority left-to-far-left media; also through the very deep state, which, in Israel, is entirely controlled by individuals who have total disregard for their Jewish or biblical heritage, their God-given rights over this land, their ancestral land.

Major Change in Israel’s Governance System Is Overdue

Without first reforming the country’s judicial branch, which has hijacked the country’s entire governance system, the chance for a much needed major governance approach change in Israel to take place is put in doubt.

The self-elected Supreme Court of Israel has assumed the country’s sovereign power, placing itself above the legislator and the executive branches. Its actions over time have created a governance conundrum that it should help resolve, but ignores and refuses to, a conundrum the politicians have tried to resolve but so far failed.

Recently, after Justice Minister Yariv Levin had tried to prevent this appointment for two years, in another undemocratic act, Supreme Court Judge Yitzhak Amit, involved in some personal unlawful behavior, self-declared himself the President of the Supreme Court of Israel. In a display of disapproval, Prime Minister Benjamin Netanyahu, Justice Minister Yariv Levin and Knesset Speaker Amir Ohana did not attend the inauguration ceremony, which was held at the residence of Israel’s President Yitzhak Herzog.

Herzog to Amit: “I condemn the subservience; there is no room for boycotts.” Herzog, who according to his presidential duty must be apolitical, yet he is, meant that in a democracy, there is no place for boycott and disqualification of a Supreme President.

Amit called out to Levin: “On behalf of the judiciary branch, I say that we are ready for a dialogue. I hope that we will meet a sisterly hand in this regard.”

As long as Israel’s Supreme Court, the Attorney General and the Military Advocate General are veering into political leftism and autocracy rather than practicing law and only law, Israel will remain the fake democracy it has become. Israel refuses to believe it is not a democracy as democracy is defined.

So long as the entire legal branch in Israel continues to protect the destructive progressive elite and exercises power it was never granted, which it hijacked, any attempt at real much-needed change will be blocked and thwarted. The country cannot move forward and have real democracy it has veered from and implemented.

Seeking the Straw to Break the Camel’s Back

I do not know what will be the straw that breaks the camel’s back.

As far as I am concerned the camel is walking around with a badly broken back – this is Israel’s democracy. Israel has lost its right to call itself a democracy. It is not. Was it ever really a democracy? In my humble opinion I think it was not.

The sights of ongoing protests in Israel’s streets, which Israelis and the world watch and what comes out of the panic button media channels must be an alarming wake-up call. These horrible sights produce horrible feelings that must be society’s awakening moment. It is now urgent for Israel to recognize the immediate need for reformation, followed by lawful, implementable actions.

Is There a Bright Side?

The bright side of it all is that we can always bring faith into it. We can pray that the God of Israel will inject some decisive wisdom into those who can and should take the actions needed.

Turning to Faith

When all else fails and we are at a loss, we can always turn to the Holy Books. According to Book of Daniel 12:1:

At that time the archangel Michael shall stand up for thy people; and should there be a time of trouble, such as never was ever till that time; and at that time thy people will run away, all who are found were written in the book and many of them who sleep in the dust of the earth shall awake, some to everlasting life, and some to contempt, and everlasting contempt in the eternal book.

So God has appointed the archangel Michael to protect His people, Israel.

The judicial conundrum in Israel is real. We can bet that with or without judicial reform, Israel will survive. Still, its survival will become much easier if judicial reform takes place immediately.

Otherwise, the high price that Israel has been paying and will be paying if the judicial system is not corrected is what is at stake.
