In a perfect ingathering storm of anti-Semitism, Jewish people’s myopia goes on. As hatred of Jews blows up from all directions, too many Jews are in their notorious denial.
Applying law to combat antisemitism is shrewdness. The opponents of the Jews do it, why shouldn’t you?
The tidalwave of antisemitism has left Europe, and sailed fast. It has already put it foot on our shores and started to flood parts of the United States’ college and university campuses. This is where the future generation’s character is being shaped.
The ripple effects from antisemitism’s undercurrent has now started to appear in places we would never have expected. It is even in the United States halls of Congress.
People who know and understand very little about antisemitism simultaneously deny any evidence of it whilst they actively participate in it!
One who knows next to nothing propagates it, reframed to fit today’s narrative. Nazi type Jew-hating propaganda, spreads like wildfire, and it is becoming increasingly dangerous.
However, one needs to know nearly everything to be able to combat this propaganda. Right now the odds are stacked in the antisemite’s favour.
The growing wave of antisemitism, specifically on college and university campuses, requires a larger spotlight to beam on this ancient human disease practice. This wave of antisemitism should grow into a national scandal. Actions, not words, are badly needed to be applied.
People, the media and politicians, from every side must stand with Jews. They must become a very loud megaphone for Jews, against antisemitism.
For the purpose of knowing as much as possible how to combat antisemitism, in the United States we have ‘The Louis D. Brandeis Center (LDB) For Human Rights Under Law,’ Alyza D. Lewin, President and General Counsel, with offices in Washington DC.
The job the independent, unaffiliated, nonprofit corporation, Louis D. Brandeis Center for Human Rights Under Law, took upon itself is to advance the civil and human rights of the Jewish people and promote justice for all. In this capacity LDB conducts research, education, and advocacy to combat the resurgence of anti-Semitism on college and university campuses.
Also there is the Hasbara Fellowships that comes to collaborate with LDB. Hasbara Fellowships is a leading pro-Israel campus activism organization working with universities across North America. Spearheaded by Aish HaTorah in 2001, every summer and winter Hasbara Fellowships brings hundreds of students to Israel, giving them the information and tools to return to their campuses, as educators about Israel.
Now LDB also brings Jewish law students to Israel and together with Hasbara Fellowships program participants they form law erudite group. These well informed students, now possessing the legal rights on campus knowledge, hold all the possibilities to break through the persuasive streak the Anti-Semites have been enjoying thus far.
More so, they will be mentoring freshmen students to stand tall and win against the anti-Semites whose goal is to deplete them of their Jewish identity.
An integral part of Jewish identity is the Land of Israel and Jerusalem, now called the State of Israel. For millennia Jews yearned for their homeland and Jerusalem, which they called Zion. The prayers and the ongoing wish of “Next Year in Jerusalem” kept the Jews together, under one identity no matter where they lived.
Nowadays, there is an ongoing effort to strip Jewish students on campuses of their deep rooted Jewish identity. To isolate and demonize them so badly so they shake off their Jewish identity and be forced to mix well with non-Jews, less their Jewish identity. Make them so uncomfortable with who they are so they drop the yearning and support for Israel as well as they do not voice their feelings and sentiments for and about Israel. In other words, shutting them down as Jews.
Shutting down pro-Israel events on campus is one of the best working weapon of the anti-Semites, such as Students for Justice in Palestine (SJP) group. They will not let anyone speak in favor of Israel and will do all they can to end such pro-Israel scheduled lecture or event before it even started. In other words, no dialogue only imposition of their point of view.
The anti-Semites often use the three ‘Ds’ method. The three Ds stand for Delegitimization of Israel, Demonization of Israel, and subjecting Israel to Double standards, each of which, according to the test, indicates antisemitism. The three Ds test of antisemitism, published in the Jewish Political Studies Review in 2004, is a set of criteria put forth by Israeli politician Natan Sharansky. It intends to draw the line between legitimate criticism towards the State of Israel, its actions and policies, and non-legitimate criticism that becomes antisemitic.
The 3Ds test of antisemitism intends to rebut arguments which say that “any criticism toward the State of Israel is considered antisemitic, and therefore legitimate criticism is silenced and ignored.” In 2010 this test was adopted by the U.S. Department of State, and in 2017 was replaced by the Working Definition of Antisemitism.
And then there is LDB’s simpler antisemitism litmus test: if one denies Jews’ self-determination in the Jewish state, Israel, in any border, it is right out antisemitism. It means the destruction of Israel. No one denied South Africa’s self-determination during the apartheid era. The anti-South Africa activism was only against the country’s apartheid policies, not is right to exist.
No words, no letters, no yelling, no condemnations will do the job the way the law can do. Ridding the world of antisemitism is humanity’s responsibility. It makes sense that one of the best tool to fight and push back anti-Semites and their antisemitism is legal actions.
If, according to USA Constitutional First Amendment Free Speech Law hate speech in the public square is permissible, such law does not apply on campus.
According to Title 6 of the Civil Rights Code, hate speech that targets Jewish identity – denies their support of the state of Israel – is not permissible on campus grounds.
According to the law of California it a criminal violation to shut down an event on campus. Law students must learn the code of law so they can stand up to the anti-Semites of all ranks, under any circumstance.
In 2019, in the United States, no-one should have to risk his or her safety and jeopardize his or her career if speaking out against antisemitism.
Sadly, among us, Jews, we have Jews who speak the anti-Semites’ language. Some Progressive Jews go as far as support some of those Jew hating lowlife groups. This type of behavior give legitimacy to the anti-Semites to spew their Jew hatred and attack Jewish identity. If Jews can do it to themselves, then, why we cannot do it to them? Respond the anti-Semites.
We, Jews, must remember our history that through countless centuries, while we lived in foreign lands, was stormed with antisemitism.
From centuries of persecution of the Jews the world has already witnessed where antisemitism can lead. It never ends well. NEVER!
Us, Jews’ engagement in the issue of antisemitism must be in direct proportionality to the amount of antisemitism and hostility to Jews and their allies are witness to, which should consume a significant portion of our life.
With organizations such as Louis D. Brandeis Center for Human Rights Under Law and Hasbara Fellowships we have our back well covered.
Because if we do not become active, the tidalwave will drown us.
Do No Stand Idly By!
