The Elements of Negligence in a Truck Accident Case

Trucks are incredibly powerful machines that are capable of a massive amount of destruction, so it’s a good thing that we have legal processes and remedies in place to protect and compensate victims. If you have been in an accident caused by a truck driver, you’ll likely need to prove that the truck driver was negligent if you want to recover damages.

But what exactly does that mean? And how can you prove each of the essential elements of negligence in a truck accident case?

Negligence and Truck Accidents

Most legal matters related to truck accidents focus on negligence. Negligence is a failure of exercising a duty of care in a way that we would expect of an ordinary, reasonable person. If a person is negligent in a way that causes harm to other people, the law provides a remedy in the form of damages. In other words, if you act negligently and hurt someone, you owe that person money to compensate them for whatever harm they suffered.

Truck accident cases usually focus on negligence because they aren’t criminal in nature, nor are they a result of intentional action on the part of the truck driver. If a truck driver was intending to harm you, or if they committed a crime, you may have a slightly different case on your hands.

The Elements of Negligence

There are four primary elements of negligence that you’ll need to prove to win your case:

  • Duty. First, you must establish that the truck driver owed you a duty of care. Essentially, this means that we as a society expected them to act in a certain way to avoid harm to others. This is an easy element to prove, as we expect truck drivers to operate their trucks in a safe and reasonable way.
  • Breach. Second, you must establish that the truck driver breached this duty in some way. Depending on the nature of the accident, this may be easy or difficult. For example, if the truck driver was excessively tired, speeding, and weaving in and out of lanes, there’s no question they breached their duty of care to others on the road. With other accidents, proving breach is substantially harder.
  • Harm. Third, you must show that you suffered harm. Harm can come in the form of property damage, injuries, medical expenses, lost wages, pain and suffering, and a number of other categories. However, you’ll bear the burden of proof to show these forms of harm.
  • Causation. Fourth, you must show a causational link between the breach of duty and the harm that you suffered. This typically means showing that the truck accident was both the actual cause and the proximate cause of your harm. Actual cause means that the harm wouldn’t have occurred unless the truck accident happened. Proximate cause means that the harm was a foreseeable result of the conduct leading to the accident.

Increasing Your Chances of Showing Negligence

There are several things you can do to increase your chances of proving negligence:

  • Work with a lawyer as soon as possible. It’s advisable to work with a lawyer as soon as you can. Your lawyer can help you understand the details of your case, gather evidence, negotiate, and even represent you in trial, if necessary.
  • Gather whatever evidence you can. In the immediate aftermath of the accident, gather any evidence that you can. Every piece of material evidence can be valuable in building your case.
  • File an official police report. Make sure to contact the police and file an official report. This is going to serve as an official record of events, so it’s important to file it in a timely and accurate manner.

Increasing Potential Compensation

There are also some things you can do to increase your potential compensation:

  • Get the medical attention you require. Get medical attention as soon as possible after the accident, and follow any medical advice you receive. It’s important for you to take reasonable care of yourself if you want to maximize your compensation.
  • Keep all your receipts. Keep all your receipts and track all your expenses for anything related to the accident.
  • Follow your lawyer’s advice. Always follow your lawyer’s advice above all else. They want to win you as much compensation as possible.
  • Be prepared to negotiate. There are many viable approaches to negotiation. No matter what, you should be prepared to negotiate – and remain patient as this lengthy process unfolds.

Proving negligence in a truck accident case isn’t always easy, even if the truck driver was acting irresponsibly. Still, with the help of a good lawyer and some decent strategizing, you should be able to show what you need to win the compensation you deserve.
