Reaction from yesterday’s Obamacare decision was predictably swift and partisan.
But one question quickly surfaced as the media, politicians, legal scholars and the general public deciphered the majority ruling.
Conservative Betrayal?
Did Chief Justice John Roberts betray his conservative reputation siding with the liberals in yesterday’s Obamacare ruling? Or did he actually give the opponents to the controversial health care law a road map out of the wilderness of its 2700 page puzzle?
“We do not consider whether the Act embodies sound policies,” Roberts wrote in his majority opinion.
His words alone kept the court from being politicized. His majority opinion included hints of where to take the ruling with phrases like “permissive reading.”
“We do not consider whether the Act embodies sound policies,” Roberts wrote. “That judgment is entrusted to the Nation’s elected leaders. It is not our job to protect the people from the consequences of their political choices, that’s why we have elections.”
Supreme Court Does Not Pick Sides
Those cheering advocates of the Supreme Court’s decision should study those carefully worded statements as a warning from Roberts and his majority. For Obamacare advocates who claim the chief justice has come over to “their side,” he rather has left the door open for a political solution.
In layman’s terms, that means vote Republican in November if you are appalled by the high court’s ruling. “We” are only here to referee the wording of the law,” Roberts ominously writes.
The shock of the decision left the nation stunned while legal analysts immediately began “decoding” Robert’s words in their proper perspective. He may have provided the best and only way to defeat this all-encompassing monster of a law.
That simply would be to vote Republican.
Setup For Presidential Election
The court’s ruling has set in motion one of the most definitive presidential campaigns in our nation’s history. Nothing could be more black and white than the issue of Obamacare.
If the voter sides with the administration’s efforts to “federalize” the country with a larger and more “involved” regulatory government to “level the playing field” of Americans, the choice is to re-elect the president.
If the voter rejects the intended course of the last four years and believes a free market with less regulation is what was intended to be a capitalist, the vote is for new leadership and a very quick end to Obamacare.
But it’s not that easy.
Only One Way To Repeal Obamacare Tax
To ensure that Obamacare is thrown out by President Romney on executive order, voters must also return the Republican House majority back to Washington and vote in four new Republican Senators. Otherwise, the order will be turned back.
The court rejected the argument that the Commerce Clause allows Washington to force citizens to purchase a product. Even though President Obama time after time rejected the notion that Obamacare was a tax, the court said in its majority opinion that it is indeed just that – a tax.
Stanford Law School Professor Michael McConnell gave the most telling description of the ruling saying, “The tax point I think is relatively harmless in the grand scheme of things because this never would have passed as a tax.”
Those few words sum up what the November election will be about. Obamacare was introduced as anything but a tax. The high court’s majority, including four liberals, say it is. That can only mean that Obama sold it with a false label. It never would have passed with the ingredients it really contained.
It’s up to the American people to set things right, if they feel there is a wrong
If the 2010 election results are any indication of what this ruling truly meant, Barack Obama is finished and the U.S. Senate will have new leadership January 20th.
