What Next for the Republic and Secularism in Nepal?

This has been asked before: “What defects were there in the 1990 Constitution that made others decide we needed another constitution?”

The leaders of the Maoists, Nepali Congress and the UML said that the constitution would be made through the Constituent Assembly (CA) within two years. But they could not draft the constitution in time. In the name of new Nepal, the culprit leaders are going through an exercise in futility.

How could they declare a republic and secularism before the new constitution was created by the CA? To extend the term after failing to draft the constitution in the stipulated time is a great betrayal. The culprit leaders of the three parties tricked the Nepalese people by extending the term of the CA that had already died. Who shall support the constitution drafted by such crooks and non visionary leaders? They can’t create an environment of consensus-government or a constitution.

From the beginning, the Interim Constitution followed the unconstitutional path by stepping over constitutionalism and was in itself handicapped. The forced declaration of the republic on 28 May 2008 was unconstitutional. When making a decision on behalf of someone, it would be against the principle of natural law to deprive him or her of the right to speak in their own defense. The Nepalese people will not support the forceful systemization of illegitimate totalitarianism by depriving the king of self defense. In fact, the royal institution has not vanished; it remains tall and strong. Fragmentation, Terrorism and Feudalism is the result of the republic and Secularism. Can they answer for the result? No – the result has been just the opposite.

Independent creative opinion is given foremost importance in all party politics. The mandate of the people’s uprising of 2005 was to establish a full democracy, not a republic, not an authoritarian rule and not communism.

The Nepalese monarchy is the most convincing identity of Nepal’s independence, sovereignty and democracy. Now, all sectors of the nation have plunged into anarchy due to their misrule. Whether the destination of CA is parliamentary rule or communism was not clear. The Maoist chairman has hinted on a possible party rule saying that the ‘people’s republic could be established’. The political leaders are still not looking for alternate ideas when the nation is nearing disintegration. The Nepali Congress is in danger of peril after opting for a republic to take revenge with the King. The plight of UML is no different after turning from opportunist to reactionary. The situation has been anarchic after the conduct of the election forcefully instigated by foreigners’ in their favor.

The republic and secularism is not Nepal’s issue. The real issues are anti-nationalism, corruption and foreign intervention. The concerns of the Nepalese people are how to get rid of the real issues. A republic is not a way out of the problems. Terrorism would take over the nation in absence of the royal institution. The elements striving to disintegrate the nation by breeding revenge and prejudice should be denounced.

How the CA election was held and what types won the election is not hidden. Murderers, pro-foreigners, criminals and thieves have emerged victorious in this election. If these people win, bloodshed will be inevitable and the devils will rule the nation.

The CA election was flanked by issues of republic, secularism, federalism, and caste based autonomy. The plight of the nation after such an election has become dangerous. National unity was mocked by the oath-taking ceremony, held in over 50 different languages, including Indian. Millions of foreigners were given Nepalese citizenship after the uprising. There were conspiracies to disintegrate the nation in the name of caste-based federalism. People who are completely unaware that the word constitution ever existed have been made lawmakers under the proportional system. The interim constitution was changed many times by completely side-stepping over the principles of the constitution. The late Girija Prasad Koirala, former Prime Minister, should be blamed for shattering the nation. Nepal will never be secure at the hands of such traitors.

A simple majority is needed to end the royal institution which carries the history of 250 years-and yet a two-thirds majority is needed to remove the Prime Ministerwho was appointed by this same King? What kind of justice is this? The Nepali Congress and UML have made a huge mistake by breaking the agreement reached with the King on 24 April, 2006. According to the agreement the sovereignty would be vested on the people and a ceremonial royal institution would be maintained. Where is it now?

How will trust be maintained in cases where agreements are broken? The effort by political leaders’ to break the backbone of the nation, the royal institution and Hindu Kingdom, is their own failure. An amendment of the constitution has been sought to remove the provision of two-third majority needed to oust the Prime Minister. With the help of NC and UML, a simple majority was sought instead. The Maoist party understands that foreign powers are looking to finish them off one by one. The Nation is at the blink of disintegration. The principle of balance and control has shattered. There is no government. A declaration of republic and to extend the time of the CA, through force and conspiracy, is unconstitutional.

In the context of the Nepalese monarchy some people including RPP-Nepal are pleading to decide republic, secularism and federalism by Referendum. But, that is also impracticable, because we can’t hold a referendum to decide whether the nation should be kept independent or colonized by India.

Nepali scholar, political analyst, and former minister of NC, Din Bandu Aryal says-‘ it is not appropriate to make a decision regarding the royal institution and religion through referendum. We can’t hold a referendum for changing the nation’s identity, which has already been established.’

When the traitors, leaders of the so-called three big Parties, declared a republic, the Nepalese people were robbed, looted and left with no security. We are still suffering through insecurity, anarchy and terror – at a point where everything is costly. So, if Nepal is to be saved, then the UNMIN and other foreigners must be chased away. The nation can be saved with the joint effort of nationalist elements within parties and royalists, along with an agreement with the King.

No one can establish an agreement by violating it. All the nationalists and parties should shun the path of treason and come to an agreement which includes the king with an understanding that past mistakes and illegitimacy would not be repeated. When nationality rolls downhill it is hard to contain it. It is easy to destroy but hard to create. When our norms and values end–then Nepal’s existence will end. The Royal Institution is the official knot that ties the Nepalese of this small nation, which is located between the two big nations of China & India. The agreement of 24 April 2006 has already failed. In the presence of the monarchy, political parties and nationalist forces including the army, police and court and various organs of the nation should revive the proclamation by King Gyanendra of 20, April, 2006, according to the 1990 constitution, and all should form a party cabinet. From that, a path should be searched with everyone’s agreement to save the nation.
