Kosovo Needs to Create A Legal Army to Function as Soveriegn State

Kosovo, Very Soon With Legal Army

Being recognized as an independent and sovereign state on February 17, 2008 by 108 countries of the United Nations, it is rational and acceptable that Kosovo government and the parliament will adopt the law on transforming the Kosovo Security Force (KSF) into the regular Armed Forces of Kosovo.

This is the legal and constitutional right of the state of Kosovo, and no one in the former colonial Serbia has the moral, legal or constitutional right to deny it.

It doesn’t matter what Serbia’s authorities say by interfering in Kosovo internal issues, which is strictly prohibited by international law and the United Nations Charter. Kosovo should have its legal army as an independent and sovereign country and a member of the United Nations.

Otherwise, we cannot account Kosovo as a normal state in the context of international law and international state system. This should be clear for all Belgrade’s top officials and Serbia’s government and parliament too. And one more thing Kosovo isn’t more Serbia’s colonial plunder. It doesn’t belong any more to Serbia in any respect.

Though, according to the effective Constitution of Serbia (2006) where it is stipulated that “Kosovo is part of the Serbia territory,” Kosovo in any sense is not more the legal territory of Serbia, but a sovereign neighboring state that doesn’t have nothing common with former colonial Serbia.

In November of 2014 on the occasion of celebration of seventh anniversary of the Security Force of Kosovo, “the Commander of Kosovo Security Forces (KSF), General Lieutenant Kadri Kastrati, said tFSK will celebrate its seventh anniversary with a new name, Kosovo’s Armed Forces. As a commander of KSF, I can say that KSF is ready to be transformed into the Armed Forces of Kosovo and to commit itself to newtasks for the protection of the country and its citizens.”

At that ceremony, the Minister of Kosovo Security Force, General Lieutenant, Agim Ceku, the Prime Minister of Kosovo government Hashim Thaci and the President of Kosovo, Atifete Jahjaga weere there. The Kosovo Army, stated, “The creation of Armed Forces of Kosovo has no other alternative. It’s a priority for the parliament of Kosovo to form the Armed Forces as soon as possible in order to complete the full constitution of our state,” said thepresident.

The transformation of Kosovo Security Force into a regular army is not only one’s dream, ambition or desire, but first and foremost is the legal and constitutional duty of the top Kosovo’s institutions.

Why Serbia opposes the recognition of Kosovo’s independence and formation of the Armed Forces of Kosovo?

Among the main factors are these: military, geopolitical, economics and more. All are in function of the returning back of Serbia in its previous colonized Kosovo(1912-1999), after the end of the historical, humanitarian, military andpeaceful KFOR mission in Kosovo.

This is the main reason why the official Belgrade does not recognize Kosovo’s independence nor its formation of a regular army as its legal protector because it would be the easiest way for Serbia to re-invade and re-colonize Albanian Kosovo.

This Serbian political and military strategy for colonization and occupation of Kosovo, dates back to the first occupation of Kosovo in the fall of 1912, where Serbian armies had “pacified” Albanian Kosovo, preliminarily by force. Otherwise, if the Albanians had been armed, the Serbs would not have had any chance to occupy Kosovo and to kill and massacre over 150,000 Albanians during 1912-1913 years on behalf of the liberation of the “Serbia’s territories” from the Ottoman Empire.”

So as not to repeat such a strategy of Serbia (1912-1999) against Albanians and Kosovo, the government and parliament of Kosovo, should as soon as possible, adopt the relevant law for the formation of the Armed Forces of Kosovo. This should be their primary task, regardless of whether political leaders of Serbia agree or disagree with the formation of the regular army of Kosovo because that isn’t an internal Serbian issue, but Kosovo’s.

Nowhere in the world, even in the Balkans region there are no states without their own army. The independent and sovereign state of Kosovo should also have its own army.

Therefore, Kosovo’s leadership should be very clear that formation of the national army there cannot be any kind of object of political or diplomatic negotiations with Belgrade. Otherwise, we cannot count any secure perspective and bright future of the fundamental vital state values: order, justice, safety, welfare, democracy and peace for all citizens of Kosovo as a multi ethnic society without creation of Kosovo’s armed forces. Kosovo’s multi-ethnic army will be in according to the requirements and needs of the Republic of Kosovo, defined by law and constitution, as well as in accordance with NATO standards.
