Shegerian & Associates Helps Saleswoman Win $1,270,000 Harassment and Breach of Employment Contract Case

Ms. Welch, a salesperson for 22 years at Ivy Hill Corporation in Los Angeles, worked for the company since 1987. She was fired in March of 2009 in what the employer called a lay-off. Welch won her age harassment and breach of implied employment contract not to terminate without good cause claim, obtaining a verdict in excess of one million dollars as decided by a jury of twelve persons in Los Angeles on Tuesday afternoon.

Welch sued alleging age discrimination, age harassment in breach of contract. The jury found in her favor on all of these claims except the discrimination claim. Attorney Carney Shegerian filed the state civil rights lawsuit in the Los Angeles Superior Court in May of 2009.

During trial, Welch testified a company executive harassed her based on her age and tried to hire only younger employees. Her supervisor made numerous derogatory comments to her about her age while questioning her work abilities and writing her up for false issues. She also testified that despite being able to perform her job well, Ivy Hill Corporation tried to and took away a financially lucrative account and eventually fabricated a reason to fire her.
