Brookstone Law PC Sees Decision Against Bank Of America as Warning to Homeowners Battling Mortgage Foreclosure to Find Knowledgeable Real Estate Lawyers
Unique Victory Shows Need for Expert Legal Help to Stop Wrongful Foreclosures and Protect Consumer Rights
The homeowner, Dave Graham of Big Bear City, Calif., applied for a mortgage loan modification under the Obama administration's Home Affordable Modification Program (HAMP), which offers borrowers a five-year loan modification if they make reduced mortgage payments during a three-month trial period. According to media coverage (http://bit.ly/fE8eIP), as Graham discovered and as federal auditors have pointed out, reduced mortgage payments can sometimes cause the very home foreclosures that the program was created to prevent (Bank of America's mortgage division, BAC Home Loans Servicing LP).
"After his unique victory, it would be sad for Mr. Graham to lose his home, but mortgage lenders can afford the expenses of delaying justice for a long time. With effective legal help, he might have received greater monetary damages in a mass joinder case. He may also have benefitted from other real estate agreements that stopped foreclosure proceedings on his property during the lawsuit," said Torchia.
Brookstone Law is investigating cases around the country against banks and mortgage lenders including Bank of America for numerous unfair, deceptive, fraudulent, and predatory real estate lending practices, some of which include HAMP violations and cases throughout the nation where clients are taking the banks to task for unlawful lending practices.
Media coverage included the admission by Bank of America mortgage service specialist Anthony Lopez that the bank continued taking the homeowner's payments even after the homeowner had no chance of getting a mortgage loan modification.
"Mr. Graham may have hurt his own chances of getting greater relief, because he did not know all his legal options in light of the grievous injury apparently done to him. These important areas of the real estate law and knowledge of actions in the courts related to the foreclosure crisis are where Brookstone Law can help consumers like him the most," said Torchia.
