Designer Sherri Hill Continues to Get Tough With Knockoff Dresses

NEW YORK, Aug. 6 /PRNewswire/ -- Sherri Hill, distinguished and successful designer of high quality prom dresses and evening gowns, continues to get tough with knockoffs of her well-known designs.

Today, the designer filed a federal lawsuit against Nox Anabel, Inc., a Los Angeles-based dress wholesaler, for knocking off distinctive elements of several of Sherri Hill's well-known dresses.

Only two months ago, Sherri Hill reached a favorable settlement of a similar copyright and trade dress infringement action against Los Angeles-based dress wholesaler Let's Fashion, Inc. Similar to claims made by Sherri Hill against Let's Fashion, Nox Anabel is accused of distributing infringing dresses to boutiques and retailers.

The Gioconda Law Group PLLC, a New York-based brand protection law firm, filed both federal lawsuits, specifically alleging that the California-based dressmakers had copied numerous distinctive and copyrighted bead and embroidery designs owned by Sherri Hill, and that employees were describing them as Sherri Hill designs.

To settle the first case, with its consent, Let's Fashion was permanently ordered by the Court to cease manufacturing, importing, exporting, selling, offering for sale, marketing, advertising and distributing any "Copies of Sherri Hill's Products," and agreed that it would ship all of these remaining products in its possession, custody and/or control to Sherri Hill, who said she destroyed them.

Let's Fashion also agreed that its employees would not make reference to Sherri Hill in any advertising or verbal sales pitches for any products. Other aspects of the settlement were not disclosed.

"We are pleased with the outcome of the Let's Fashion lawsuit, and with the cooperation we received from Let's Fashion, particularly in receiving information from them about their sale of the accused products. We look forward to continuing to protect Sherri Hill's distinctive designs and valuable brands against infringers," said Joseph C. Gioconda, attorney for Sherri Hill.
