Price Match Consumer Class Actions Against Best Buy Expanded to More States by Kantrowitz, Goldhamer & Graifman, P.C.
Consumers in New York, California,
Illinois and New Jersey are fighting back because Best Buy has denied their
price match requests. The law firm of Kantrowitz, Goldhamer & Graifman,
P.C. and its co-counsel, having won class action certification in New York,
have now expanded the suit and filed additional lawsuits on behalf of
consumers in California, New Jersey and Illinois. The firms have moved to
have all four actions transferred and consolidated in the Southern District
of New York.
The lawsuits allege that Best Buy is violating Consumer Protection Laws by
failing to honor its public price match guarantee. Specifically, the
lawsuits allege that: Best Buy advertises, promotes and uses its price
match guarantee to affect sales. However, since price matching is
unprofitable, Best Buy has an undisclosed policy of erecting strategic
barriers to aggressively deny customers' price match requests. Best Buy's
Anti-Price Matching Policy has been confirmed by multiple former employees,
techniques for denying price match requests are taught at Best Buy's
facilities and Best Buy provides financial incentives for denying price
match requests. One technique, the use of a secret intra-net site with
phony prices, is being challenged by the Connecticut Attorney General.
On January 10, 2008, Kantrowitz, Goldhamer & Graifman, P.C. filed the first
Best Buy Price Match lawsuit, Jermyn v. Best Buy Stores, L.P., in the
Southern District of New York. On March 19, 2009, the Court certified the
Jermyn class action and on October 8, 2009, the United States Court of
Appeals denied Best Buy's request to appeal. The law firms have now filed
Truong v. Best Buy Co., Inc. in California, DiSanto v. Best Buy Co., Inc.,
in New Jersey and Laff v. Best Buy Co., Inc. in Illinois. On October 28,
2009, the law firms moved to have all four actions transferred and
consolidated in the Southern District of New York.
