Florida Governor Charlie Crist appointed Judge Donald W. Hafele, former member of "Fairness of Elections Committee" appointed by Jeb Bush, to 15th Judicial Circuit after being notified by Crackhead Jesus author, Victor-Hugo Vaca Jr., of controversial judge's alleged racial bias.
A sticky situation looms over the Presidential race that highlights the prejudice which remains in parts of the U.S. justice system that threaten a fair United States election in 2008. The Modern Art Music Movement (MAMM) Founder Victor-Hugo Vaca Jr. received a letter from the office of U.S. Senator Barack Obama, stating that the office of Sen. Bill Nelson has been contacted regarding the recent ruling by Judge Donald Hafele in Case #50-2006-CC-016579, also known as "The Crackhead Jesus Trials."
Vaca submitted six emergency motions to disqualify Judge Donald W. Hafele, all of which were denied.The Hispanic multimedia artist and former dark horse presidential candidate based his emergency petition on the Writ of Prohibition presented by George W. Bush, Richard Cheney, and the Republican Party of Florida in 2000. (DCA Case No. 1D00-4717, Lower Court Case No. 00-2816.)
Judge Hafele claims the legal argument that a determination must be made as to whether the facts alleged would place a reasonably prudent person in fear of not receiving a fair and impartial trial, is now "legally insufficient."
"I reported the fact that the law in Florida only seems to protect white Republican presidential candidates - not minority presidential hopefuls - to Governor Crist's office via phone and e-mail correspondence," Vaca claims.
The artist, who some are comparing to a modern day Andy Warhol, says he is shocked that Governor Crist would elevate Judge Hafele to such a position days before the election. In researching his Crackhead Jesus iNovel, Vaca uncovered the fact that there is no oversight over the Florida Bar president who determines the standard of ethics and competency for lawyers.
"When government sets a low standard of ethics and competency for an attorney, that's dangerous, especially if those lawyers decide to become judges, Supreme Court Judges, or presidential hopefuls such as Barack Obama," Vaca says.
