Flachsbart & Greenspoon Wins Significant Victory at Court of Appeals

LLC today won a significant victory for its client, 1st Technology, LLC. Robert P. Greenspoon, a founding member of the firm, argued the appeal from Bodog's attempts to set aside a judgment in the amount of $46,597,849. The firm today obtained a per curiam affirmance of the judgment against Bodog.com, Bodog.net, and Bodog Entertainment Group S.A.

Bodog was sued by 1st Technology for patent infringement based on Bodog's distribution of software used for online gaming. Bodog's online gaming operations make it one of the leaders in the industry, with Bodog claiming to have handled $7.3 billion in online wagers in 2005, generating sales of over $210 million. With interest, the amount due 1st Technology from Bodog now exceeds $50 million.

Despite numerous challenges by Bodog to the judgment entered by the U.S. District Court for the District ofNevada, the Court of Appeals for the Federal Circuit today affirmed the lower court's ruling.

Mr. Greenspoon stated, "We are extremely gratified for our client that the Court of Appeals saw the merits exactly the way we did."

The affirmance in Appeal No. 2008-1132 marks Flachsbart & Greenspoon's second victory in a multi-million dollar case before the Federal Circuit since the firm opened its doors in 2007.
