Dozier Internet Law: Secure Computer, LLC Pulls Software From Market
Response To Washington State And Microsoft Litigation

On Tuesday afternoon, lawsuits were filed against Secure Computer, LLC by the Washington State Attorney General and Microsoft Corporation. The company first became aware of these lawsuits yesterday, January 25, 2006.
Secure Computer, LLC has no internal technology or IT staff, and the program that is distributed as Â"Spyware CleanerÂ" was developed by a contractor who has developed three other popular anti-spyware applications presently being sold and distributed, and who is responsible for the coding of at least two or three additional anti-spyware programs. The company had confidence in this contractorÂ's ability to deliver a high quality product, and since this lawsuit was filed, extensive review of the software has been initiated.
Based upon a technologistÂ's review of the logic of the software and database contents, Secure Computer, LLC has confirmed that some of the problems with the software alleged in the lawsuit appear to exist and some of the problems alleged do not exist or are not problems at all. The company is mindful of the fact that independent researchers have recently concluded that the software is Â"not a scamÂ" .
Certainly there are subjective elements involved in determining the various categories of risk, Microsoft alleges in its lawsuit that Â"cookies...pose little or no risk to the user,Â" but Secure Computer disagrees.
Secure Computer, LLC is committed to providing the highest quality product and until such time as independent consultants can fully assess, identify, address and resolve the issues raised by the State of Washington and Microsoft Corporation, company management has directed that the product line including Â"Spyware CleanerÂ" be removed, effective immediately, from the marketplace for all sales
and distribution.
The company continues to evaluate the contentions asserted in this litigation, and only when the product performs in accordance with appropriate industry standards will the product be re-launched.
